Wish Referral Program Terms

The Wish Referral Program (the “Program”) is a program for Wish users to earn promotions by referring new users to Wish. These Terms (these “Terms”) govern participation in the Program. These Terms supplant and replace in their entirety any terms which previously governed any Wish referral program. In these Terms we refer to “ContextLogic Inc.” as “Wish” or “we” and to users providing the referral link as “you.” All references to “Friend” refer to the person receiving your referral link. If you participate in the Program, including by sharing a link or any other content issued under the Program, you agree to these Terms. Use of the Wish website(s), products, services, and applications are governed by the Terms of Use and Privacy Policy, which are incorporated into these Terms by reference, including the dispute resolution requirements of the Terms of Use.

Currently, the Program is available only to users resident in the United States.

How to Participate in the Referral Program

You may earn promotional codes (“Referral Codes”) by referring Friends to the Wish application or website(s) (“Wish Platforms”). To participate, you must share your referral link with Friends who are (i) new users or (ii) users who have not made a purchase for a certain period of time (to be determined by Wish in its sole discretion). You can share your referral link from various sharing elements on the Wish Platforms, including a product’s detail page or Participant’s wishlists. Each Friend you refer who clicks on your referral link will receive a referral discount, promotional code, or other offer according to the terms of the Program that must be used prior to such offer’s expiration.

Earning Referral Codes

Referral Codes are earned when your Friend uses your referral link to make a qualifying purchase on the Wish Platforms and that purchase has shipped (subject also to any other conditions listed herein). If the referral link is attached to a referral discount, promotional code, or other offer, then the Friend must also make a qualifying purchase prior to that offer’s expiration.

Referral Codes and offers tied to referral links are subject to the Promotional Code Policy and other terms which may impose restrictions or other conditions, including a minimum spend, categories of products, limits on how many promotional codes a user may have, whether a promotional code may be used with other offers, and expiration. Promotional codes and offers must be entered and/or applied at checkout. Any discount is applied to your order total before taxes and shipping. Promotional codes and offers  cannot be applied to previous purchases and have no cash value.

Sharing Referral Links

Referrals should only be used for personal and non-commercial purposes, and only shared with personal connections that will appreciate receiving these invitations. You may not collect Referral Codes by:

• Self-referring by using multiple or false names, identities, accounts, or email addresses;
• Referring anyone who is an existing Wish user, including an existing user with an account under an alternate email address;
• Using spam or sending unsolicited emails to people you don’t personally know to collect referrals, or otherwise violating any applicable law, rule, regulation or third party terms of use;
• Posting on message boards, internet advertisements, public forums, coupon sites, or other online venues;
• Permitting another individual to use your account;
• Referring fake people to Wish, impersonating another person, or otherwise providing Wish with false or misleading information;
• Using your referral link or any other Wish-provided content in any manner that is fraudulent, invasive, unlawful, or disparaging or that otherwise portrays Wish in a negative light;
• Violating, or otherwise encouraging the violation of, the legal rights of others; or
• Any other restriction we impose on participants in the Program in our discretion upon prior notice.

If Wish determines in its sole discretion that there has been a violation of these Terms or abuse of this Program, Wish reserves the right to cancel or rescind your Referral Code, cancel the Friend’s discounted order, and/or determine that one or both parties are ineligible to participate in this Program or future offers. You may also be liable for civil and/or criminal penalties under applicable law. We reserve the right to void, verify, or adjust Referral Codes at any time prior to or following posting and redemption.

Your Responsibilities

You represent, warrant, and covenant that (a) your participation in the Program and will not violate (i) any applicable laws, regulations, rules, guidelines, codes of practice, industry standards, self-regulatory rules (including any rules governing communications, data protection, advertising, and marketing); or (ii) any contract or other binding obligation to any third party, including policies governing the use of various social platforms; (b) you are 18 or older or have the legal authority and are lawfully able to enter into contracts; (c) you are not the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are participating in the Program; (d) each referral you provide to a Friend will be reasonably made in good faith; and (e) the information you provide in connection with the Program is accurate and complete you will take reasonable steps to keep it in this condition.

General

We may revise these Terms at any time, and without notice to you, in our sole discretion, to change, cancel, suspend, modify, or discontinue any aspect or of the Program or the entire Program. You can review the most current version of the Terms at any time on this page. Continued participation in the Program after any modification shall constitute acceptance and consent to such modification. These Terms, as supplemented by the Wish Terms of Use and Privacy Policy (including with respect to the terms on Content; License, Limitation of Liability, Warranty Disclaimer, Indemnity, Arbitration, and General provisions), constitute the entire agreement and understanding between you and Wish with respect to the subject matter hereof and supersede all other communications, whether oral or written, between the parties with respect to such subject matter.  You represent that you are not relying on any statement or guarantee about the Program except those contained in these Terms. Wish’s failure to enforce your strict performance of any provision of these Terms will not constitute a waiver of Wish’s right to enforce such provision or any other provision of these Terms. If any provision in these Terms is held to be invalid, void, or unenforceable, such provision (or the part of it that is making it invalid, void or unenforceable) will be struck and not affect the validity of and enforceability of the remaining provisions. You may not assign these Terms, by operation of law or otherwise, without Wish’s prior written consent.  Any attempt to do so shall be void. Subject to the foregoing restriction, these Terms will be binding on, inure to, and be enforceable against the parties and their respective successors and assigns.
